If you are recommended to give a dollar cost estimate on «form SC100» when filing a small claims, instead insist on an exact dollar amount of all costs, including the process service cost of $ 75, if completed by Team Legal &SC100 form filing of $ 225. Keep these filing and process service costs in mind when accepting filing assistance for lower dollar small claims cases. You may be told that the claim amount can be changed later in front of the judge. In my case, the SC100 stated amount was the only gauge utilized and additional costs not originally included on the SC100 were not up for consideration during the small claims court trial. In all Simi Valley small claims cases, the judge and a volunteer group during court, insist on arbitration and they go by what is on the original SC100 filing. Costs not mentioned on the original filing, in my case, were subsequently not factored in the arbitration negotiation. In hindsight, it would’ve been easier to arbitrate a higher win had all costs been itemized upfront Vs. the recommended estimate amount. The other option could’ve been to take a chance with the judge. All litigants were told in court, should parties choose not to accept the arbitration option, going in front of the judge may not have a favorable outcome. With arbitration, you save time but, «no one wins».
